Experts to Address Legal Regulation of Investments and Resolution of Relevant Disputes at SPILF

The session ‘Investments and Dispute Resolution within BRICS’ will take place at the 11th St. Petersburg International Legal Forum.

The session will consider the unification of legal regulation aimed to protect of investors’ rights in the BRICS countries, as well as the establishment of a BRICS International Arbitration Centre for the impartial and independent resolution of investment and other categories of disputes.

“Today we can see how the inviolability of property rights and the fundamentality of the right to judicial protection are being questioned in favour of the political ambitions of certain countries. Insurmountable obstacles are starting to arise for initiating arbitration proceedings, paying fees, engaging technical specialists and subject-matter experts, and enforcing arbitral verdicts,” said Andrey Loginov, State Secretary – Deputy Minister of Justice of the Russian Federation.

He noted that, at the same time, trade and economic ties between the BRICS countries continue to expand. This entails the need to create common institutions that would allow for long-term partnerships on the basis of equality.

According to Deputy Minister, one such institution could be the BRICS International Arbitration Centre, designed to ensure proper protection of the rights and interests of investors and states.

For example, the Russian Ministry of Justice, together with the Ministry of Foreign Affairs, the Ministry of Economic Development and Saint Petersburg State University, has drafted a concept for the creation of such a centre, as well as an action plan for its implementation.

The 11th St. Petersburg International Legal Forum will take place on 11–13 May. The Forum is organized by the Ministry of Justice of the Russian Federation and the Roscongress Foundation.
