A Digital Code: Prospects and Risks

The codification of information and digital legislation has become a trend in the legal systems of EAEU and CIS member states. Kyrgyzstan and Kazakhstan are developing digital codes, and Azerbaijan has announced plans to develop one soon. Russia has prepared its own Concept of the Digital Code of the Russian Federation and is currently working on determining its optimal structure. Upcoming changes and legislative innovations in the regulation of digital and information technologies, the Internet, the communications industry, data processing, the functioning of digital platforms, and the use of artificial intelligence technologies will have a major impact on how the state, the digital economy, society, and business all function. What pillars of information relations should the Digital Code regulate? What is the most effective way to organize the development of the Digital Code? What experience from foreign legal systems could be used when developing the Digital Code? What approaches to regulating artificial intelligence technologies, big data, digital platforms, and other digital technologies need to be enshrined in the Digital Code? What risks could arise when developing the Digital Code?

In 2020, he became a member of the Civic Chamber of the Russian Federation and was appointed as the head of the working group on legislation in the field of Internet technologies and digitalization.

He is also Skolkovo Foundation expert and lecturer at the Military Academy of Strategic Missile Troops and the Military Academy of the General Staff of the Armed Forces, where he delivers lectures on big data, social networks, and information warfare.

Oleg Belyavsky

Oleg Belyavsky was born in 1959 in a service man family. After graduating from the Law Faculty of the Military Red Banner Institute in 1980, he served for more than 14 years in the system of military prosecutor’s office and military courts, as well as in the central office of the Russian Defense Ministry. Participated in the drafting of several bills and agreements in the field of international humanitarian law. Later on he worked in senior positions in banking and industrial spheres, headed JSC «State Institute of Nitrogen Industry and Organic Synthesis Products», for more than twenty years he consulted Russian and foreign investment companies and funds. Since 2014 he is working as CEO of the Russian Foundation for Basic Research. PhD in Law.
Scientific interests of O.V. Belyavsky include state, civil and financial law and in particular legal regulation of national science state support, expert activities in the scientific and technical sphere. He is currently member of the working group of developing a national system for evaluating the publication activity and effectiveness of Russian scientists and scientific organizations.
