Amidst reciprocal unilateral restrictive measures, international commercial arbitration is becoming the most convenient, neutral, and effective method for protecting the rights of Russian entrepreneurs actively engaged in foreign economic activity. Over the past year, the field of international commercial arbitration has undergone significant changes, primarily of a practical nature. There have been unprecedented obstacles in foreign arbitration proceedings involving Russian individuals, modifications in the selection of arbitration institutions' priorities and criteria, new approaches to structuring arbitration clauses, and the emergence of new court practices in recognizing and enforcing arbitral awards. What are the current trends in the field of international arbitration? What issues does Russian business regularly encounter?

Prof Asoskov, LL.D., is a Professor of the Private International Law Department at the Alexeev Research Centre of Private Law. He has acted as an arbitrator in more than 100 international arbitrations under all major institutional rules and the UNCITRAL Arbitration Rules. He is a member of the governing bodies of the Hong Kong International Arbitration Centre (HKIAC), the German Arbitration Institute (DIS), the International Commercial Arbitration Court at the Russian Chamber of Commerce and Industry (ICAC) and the Russian Arbitration Centre at the Russian Institute of Modern Arbitration (RAC).

Dmitry specialises in international commercial and investment arbitration and has vast experience representing the government and major state corporations, Russian and foreign companies in arbitration processes under the rules of ICC, SCC, LCIA, SIAC, ICDR, UNCITRAL, and the ICAC of the Russian Chamber of Commerce and Industry. Dmitry consults clients operating in various industries, including oil and gas, banking, and construction, etc.
Dmitry is admitted to the Moscow Bar Association and is a member of its International Relationships Committee. Dmitry leads the ICC Arbitration Commission in Russia and the Investment Arbitration Working Group of the Russian Arbitration Association. Maria's main areas of expertise include international private law, corporate law, arbitration and financial markets. Maria specializes in cross-border disputes and disputes complicated by a foreign element as well as IT and IP regulation.

Maria is a consultant of The Private Law Research Centre under the President of the Russian Federation named after S.S. Alekseev, Reporter of the ICAC at the RF CCI on Internal and International disputes.

Since 2020, Maria has been included in the list of recommended specialists in financial disputes of the Russian Arbitration Center. Maria has received CIArb Associate Member status (The Chartered Institute of Arbitrators).
Maria is a member of the Editorial Board of the Commercial Arbitration Journal. She is the author of publications on Russian and foreign law, ADR issues, including comments on the decisions of the ICAC at the Chamber of Commerce and Industry.

For three consecutive years Maria has been recommended in the lawyers’ individual ranking of the publishing house “Kommersant” in commercial disputes.

Maria has extensive experience in public speaking.

EDUCATION

In 1997 graduated from the Moscow State Law Academy (International Private Law Department).
In 1997 – 2001 studied for Postgraduate degree at the Centre of Legal problems of international economic relations of the Institute of State and Law, established by the Russian Academy of Sciences. Upon completing the course in 2002, defends his PhD thesis titled “The Legal Regulation of the International Financial Leasing”.

EXPERIENCE

1994 - 2003 Private legal practice, has worked in a numerous Russian companies as a compliance officer.
During 2003 - 2012 has worked at the Chamber of Commerce and Industry, including the position of Deputy Director of Center of Arbitration and Mediation at the Chamber of Commerce and Industry of the Russian Federation, in creating of which had participated actively. He has coordinated development and popularization of arbitration courts including the International Commercial Arbitration Court, improvement of arbitration’s legislation, promotion of opportunities of the CCI in the field of the international arbitration.
Participated in the drafting of rules and other documents governing the dispute resolution in various arbitration courts at the Chamber of Commerce and Industry of the Russian Federation.
In 2012-2016 - Deputy Director for Legal Affairs of ANO "Independent Arbitration Chamber".

OTHER SPHERES OF THE PROFESSIONAL ACTIVITIES

Has the practice of the arbitration settlement of disputes in a number of institutional arbitrations in Russia and abroad, including the International Commercial Arbitration Court at the Russian Chamber of Commerce and Industry (since 2005) in the capacity of the chairman at arbitration membership, sole arbitrator, member of an arbitration membership (acted as arbitrator in more than international 150 arbitration proceedings with a number of companies from more than 35 countries). Has experience in the sphere of the international arbitration settlement of disputes according with Swiss Regulations of the international arbitration court at the Chamber of Commerce and Industry in Geneva, Switzerland, acted as an arbitrator under the rules of the International Chamber of Commerce in Belgium, investment arbitration ad hoc under Regulations of the UNCITRAL, Paris.

Не participated as an expert the preparation of some Resolutions of the Plenum of the Supreme Court of the Russian Federation, including documents on the issues on the resolution of disputes with foreigners.
The author of certain scientific and practical published works dealing with international contractual obligations and a range of problems in settlement of commercial disputes. Also co-author of commentary on the Civil Code of the Russian Federation (ed. Тamara Abova), Moscow, 2004; Private International Law (MGIMO (U), ed. Sergei Lebedev, Elena Kabatova), Moscow, 2013.
One of the scientific editors and author of the books: Сommentаry on the Federal Law on Arbitration in the Russian Federation (ed. Oieg Skvortsov, Mikhail Savranskiy). Among the areas of research and areas of professional practice is effectiveness improvement and optimization of the arbitration procedure, especially considering the complex international disputes.
Delivers a courses of lectures on "Key issues of resolving international commercial disputes", "International Commercial Arbitration" at Russian School of Private Law.
He is a regular speaker at international legal conferences.
