SPILF 2024 participants discuss ways to improve state systems of pre-trial restrictions

The
session ‘Punishment before Sentencing: Is There an Alternative to Detention?’
was held as part of the 12th St. Petersburg International Legal
Forum (SPILF) on 27 June 2024.
The
session participants discussed some of the best practices for improving state
systems of pre-trial restrictions, and also examined international experience
in introducing new digital technologies in this area.
Russian
Deputy Minister of Justice Vadim Fyodorov noted that Russia has been
constantly reforming its system of pre-trial restrictions in recent years. For
example, last year a federal law drafted by the Russian Ministry of Justice was
adopted to clarify the grounds for imprisoning entrepreneurs. In particular, a
court ruled that the use of pre-trial restrictions that allow for continuing
business activities must be a priority.
In
addition, a legislative initiative of the Supreme Court is currently being
discussed to limit the use of pre-trial detention for persons who have
committed non-violent crimes, women with young children, and people suffering
from serious illnesses.
Wrapping up his speech, Fyodorov said it was important to expand the
practice of using bail as a pre-trial restriction and develop a methodology to
determine the amount of bail.
