SPILF 2024 participants discuss areas for the development of criminal legislation
On 26 June
2024, the 12th St. Petersburg International Legal Forum held a
session entitled ‘Criminalization and Decriminalization: Striking a Balance’.
The participants
in the session discussed the relationship between criminalization and
decriminalization trends and how to find a balance between the two, taking the
specifics of the development of criminal legislation into account. They also
considered draft legislation that aims to improve and systematize a number of
criminal legal institutions.
Deputy
Minister of Justice of the Russian Federation Vadim Fedorov spoke about
the work the Ministry is doing to liberalize criminal and administrative
legislation, including economic legislation.
Fedorov
noted that the criminal and criminal procedural legislation in its current form
requires significant reform. It should be based on the objective conditions of
social development and the strategic course taken by the state in the fight
against crime and set out in the concept of criminal law policy.
“We see the Concept as a document that is aimed at creating a logical,
unified and systematic state policy to counter dangerous acts and the threats
associated with them through criminal legislation. The Ministry of Justice of
the Russian Federation has set up a working group to develop such a document.
The group includes representatives of the government authorities, legal
scholars, and practicing lawyers,” Fedorov noted.
The Deputy
Minister said that the concept will suggest legislative measures that will set
out the criteria for the criminalization, penalization, and mitigation of
responsibility under the law.
